NAGRAM website-এ আপনাকে স্বাগতম। এই website ব্যবহার করে, আমাদের products ব্রাউজ করে অথবা কোনো order করার মাধ্যমে আপনি এই Terms of Service-এর শর্তাবলীতে সম্মত হচ্ছেন।

অনুগ্রহ করে কোনো product order করার আগে এই Terms of Service, Shipping Policy এবং Return & Refund Policy ভালোভাবে পড়ে নিন।

১. Website ব্যবহারের শর্ত

এই website এবং এর content শুধুমাত্র বৈধ উদ্দেশ্যে ব্যবহার করা যাবে।

Website ব্যবহার করার সময় আপনি:

- সঠিক ও সত্য তথ্য প্রদান করবেন;
- অন্য কোনো ব্যক্তি বা প্রতিষ্ঠানের পরিচয় ব্যবহার করে order করবেন না;
- fraudulent বা fake order করবেন না;
- website-এর security বা functionality ক্ষতিগ্রস্ত করার চেষ্টা করবেন না;
- website-এর কোনো অংশ unauthorizedভাবে copy, reproduce বা commercially exploit করবেন না;
- কোনো বেআইনি বা প্রতারণামূলক কাজে website ব্যবহার করবেন না।

NAGRAM সন্দেহজনক, fraudulent বা abusive activity শনাক্ত হলে কোনো order বাতিল বা প্রয়োজনীয় ব্যবস্থা নেওয়ার অধিকার রাখে।

২. Product Information

আমরা আমাদের products সম্পর্কে যতটা সম্ভব accurate information প্রদান করার চেষ্টা করি।

Product page-এ থাকা:

- Product name
- Description
- Images
- Videos
- Specifications
- Size
- Color
- Materials
- Features
- Availability

ইত্যাদি information product সম্পর্কে customer-কে ধারণা দেওয়ার উদ্দেশ্যে প্রদান করা হয়।

তবে device display, lighting, photography বা screen settings-এর কারণে product-এর actual color ছবির তুলনায় কিছুটা ভিন্ন দেখা যেতে পারে।

কোনো product-এর availability, specification, price বা অন্যান্য information ভুল থাকলে NAGRAM প্রয়োজন অনুযায়ী তা সংশোধন করার অধিকার রাখে।

৩. Product Price

Website-এ প্রদর্শিত product price পরিবর্তন হতে পারে।

NAGRAM যেকোনো সময়:

- Product price পরিবর্তন করতে;
- Discount বা promotional offer পরিবর্তন করতে;
- কোনো offer বন্ধ করতে;
- কোনো product-এর availability পরিবর্তন করতে

পারবে।

তবে কোনো order গ্রহণ ও confirm করার পর price-related কোনো সমস্যা দেখা দিলে বিষয়টি customer-এর সাথে আলোচনা করে প্রয়োজনীয় ব্যবস্থা নেওয়া হবে।

৪. Order Placement

Website-এর মাধ্যমে order submit করার অর্থ এই নয় যে orderটি automatically final বা confirmed হয়ে গেছে।

Order submit করার পর NAGRAM প্রয়োজন অনুযায়ী order information যাচাই করতে পারে।

Order confirmation-এর জন্য customer-এর সাথে:

- Phone call
- SMS
- WhatsApp
- অথবা অন্য কোনো communication method

এর মাধ্যমে যোগাযোগ করা হতে পারে।

প্রয়োজনীয় verification সম্পন্ন হওয়ার পর order confirm করা হতে পারে।

৫. Order Confirmation

NAGRAM যেকোনো order গ্রহণ, verify, modify অথবা cancel করার অধিকার রাখে।

বিশেষ করে নিচের পরিস্থিতিতে order confirmation-এর আগে additional verification প্রয়োজন হতে পারে:

- High-value order
- সন্দেহজনক order
- একই customer-এর একাধিক order
- ভুল বা অসম্পূর্ণ information
- পূর্ববর্তী delivery/return history থেকে high delivery risk
- Product availability সমস্যা
- Pricing বা website error
- Fraudulent activity-এর সন্দেহ

Customer verification সম্পন্ন করতে না পারলে orderটি cancel করা হতে পারে।

৬. Cash on Delivery (COD)

NAGRAM সাধারণভাবে Cash on Delivery (COD) সুবিধা প্রদান করে।

সাধারণ COD order-এর ক্ষেত্রে customer product delivery পাওয়ার সময় প্রযোজ্য বাকি টাকা পরিশোধ করবেন।

তবে নির্দিষ্ট order-এর ক্ষেত্রে NAGRAM advance payment চাইতে পারে।

Advance payment-এর বিস্তারিত নিয়ম আমাদের Shipping Policy-তে উল্লেখ করা হয়েছে।

৭. Advance Payment

নির্দিষ্ট পরিস্থিতিতে order confirm বা dispatch করার আগে NAGRAM আংশিক advance payment চাইতে পারে।

এর মধ্যে থাকতে পারে:

High-Value Order:

তুলনামূলকভাবে high-value order-এর ক্ষেত্রে মোট order value-এর 10% পর্যন্ত advance payment নেওয়া হতে পারে।

Previous Delivery / Return History:

Customer-এর previous delivery, cancellation, return বা non-receipt history থেকে delivery risk বেশি হলে:

- ৳২০০ advance, অথবা
- মোট order value-এর ১০% advance

নেওয়া হতে পারে, order-এর পরিস্থিতি অনুযায়ী।

Advance payment নেওয়া হলে অবশিষ্ট প্রযোজ্য টাকা delivery-এর সময় পরিশোধ করতে হবে।

৮. Order Cancellation

Order dispatch হওয়ার আগে cancellation প্রয়োজন হলে customer যত দ্রুত সম্ভব NAGRAM-এর সাথে যোগাযোগ করবেন।

Order dispatch হওয়ার পর cancellation বা parcel return-এর ক্ষেত্রে applicable delivery এবং return charges প্রযোজ্য হতে পারে।

Customer শুধুমাত্র product পছন্দ না হওয়ার কারণে delivery গ্রহণের পর order cancel করতে চাইলে আমাদের Instant Return Policy এবং Return & Refund Policy প্রযোজ্য হবে।

৯. Instant Return

COD order-এর ক্ষেত্রে customer delivery agent-এর সামনে product পরীক্ষা করে product পছন্দ না হলে delivery agent-এর কাছেই productটি return করতে পারবেন, যেখানে courier service-এর নিয়ম অনুযায়ী এটি সম্ভব।

এই ক্ষেত্রে applicable delivery charge customer-কে বহন করতে হবে।

Delivery agent চলে যাওয়ার পর শুধুমাত্র product পছন্দ না হওয়ার কারণে Instant Return প্রযোজ্য হবে না।

Instant Return-এর বিস্তারিত শর্ত Return & Refund Policy-তে দেওয়া আছে।

১০. Return & Exchange

Product defective, damaged, wrong, significantly different from the description বা অন্য কোনো eligible issue থাকলে customer আমাদের Return & Refund Policy অনুযায়ী Return বা Exchange-এর জন্য আবেদন করতে পারবেন।

Return বা Exchange-এর ক্ষেত্রে প্রযোজ্য eligibility requirements অবশ্যই পূরণ করতে হবে।

বিশেষ করে post-delivery Return/Exchange-এর ক্ষেত্রে:

- Product unused থাকতে হবে (functional defect verification-এর জন্য সীমিত testing বাদে);
- Product-এর original packaging সংরক্ষণ করতে হবে;
- সকল applicable accessories থাকতে হবে;
- নির্ধারিত সময়ের মধ্যে NAGRAM-কে জানাতে হবে।

Return ও Refund-এর বিস্তারিত শর্ত আমাদের Return & Refund Policy-তে দেওয়া আছে।

১১. Refund / Cashback

কোনো Return বা Refund অনুমোদিত হলে returned product NAGRAM-এর কাছে পৌঁছানোর পর product, packaging এবং accessories যাচাই করা হবে।

Product এবং returned package সবকিছু policy অনুযায়ী সঠিক অবস্থায় থাকলে সম্পূর্ণ refund/cashback process করা হবে।

যেহেতু Refund শুধুমাত্র NAGRAM-এর ভুল বা confirmed defect-এর ক্ষেত্রেই করা হয়, তাই Refund amount থেকে কোনো Delivery Charge, Return Delivery Charge, Packaging & Processing Fee, বা অন্য কোনো চার্জ কেটে নেওয়া হবে না। গ্রাহক সম্পূর্ণ Refund পাবেন।

Refund-এর বিস্তারিত নিয়ম Return & Refund Policy-তে উল্লেখ করা হয়েছে।

১২. Delivery

NAGRAM third-party courier ও delivery service ব্যবহার করে product সরবরাহ করে।

বর্তমান estimated delivery time:

- ঢাকা সিটির মধ্যে: ১–২ কার্যদিবস
- ঢাকার বাইরে: ২–৩ কার্যদিবস

সরকারি ছুটি, অন্যান্য ছুটি, প্রাকৃতিক দুর্যোগ, খারাপ আবহাওয়া, courier-related সমস্যা অথবা NAGRAM-এর নিয়ন্ত্রণের বাইরে অন্য কোনো কারণে delivery time পরিবর্তিত হতে পারে।

বিস্তারিত তথ্য আমাদের Shipping Policy-তে দেওয়া আছে।

১৩. Customer Information

Order করার সময় customer-কে সঠিক:

- Name
- Mobile number
- Delivery address
- এবং অন্যান্য প্রয়োজনীয় information

প্রদান করতে হবে।

ভুল বা অসম্পূর্ণ information-এর কারণে delivery failure হলে NAGRAM তার জন্য দায়ী থাকবে না।

Customer-এর দেওয়া information-এর ব্যবহার ও protection সম্পর্কে বিস্তারিত আমাদের Privacy Policy-তে দেওয়া আছে।

১৪. Promotional Offers

NAGRAM বিভিন্ন সময় promotional campaign, discount, bundle offer, free delivery বা অন্যান্য promotional offer দিতে পারে।

প্রতিটি promotional offer-এর নিজস্ব:

- Eligibility
- Duration
- Product selection
- Quantity limitation
- Terms and conditions

থাকতে পারে।

NAGRAM প্রয়োজন অনুযায়ী কোনো promotional offer পরিবর্তন, স্থগিত বা বন্ধ করার অধিকার রাখে।

১৫. Intellectual Property

NAGRAM website-এর content-এর মধ্যে থাকা, যেখানে প্রযোজ্য:

- Brand name
- Logo
- Product descriptions
- Product photographs
- Videos
- Graphics
- Website design
- Text
- Other original content

NAGRAM অথবা সংশ্লিষ্ট rights holder-এর property হতে পারে।

NAGRAM-এর prior written permission ছাড়া এসব content copy, reproduce, modify, publish, distribute বা commercially ব্যবহার করা যাবে না।

১৬. Third-Party Services

NAGRAM website পরিচালনা ও order fulfilment-এর জন্য third-party services ব্যবহার করতে পারে, যেমন:

- Payment providers
- Courier/delivery providers
- Analytics services
- Advertising platforms
- Technology providers

এই third-party services-এর নিজস্ব terms ও privacy policies থাকতে পারে।

Third-party service ব্যবহারের ক্ষেত্রে সংশ্লিষ্ট provider-এর applicable terms ও policies প্রযোজ্য হতে পারে।

১৭. Website Availability

আমরা website-কে যথাসম্ভব নিরবচ্ছিন্নভাবে চালু রাখার চেষ্টা করি। তবে maintenance, technical issues, server problems, security incidents বা অন্য কোনো কারণে website সাময়িকভাবে unavailable হতে পারে।

NAGRAM website-এর uninterrupted বা error-free operation-এর নিশ্চয়তা প্রদান করে না।

১৮. Limitation of Liability

NAGRAM reasonable care-এর মাধ্যমে products এবং services সরবরাহ করার চেষ্টা করে।

তবে NAGRAM-এর reasonable control-এর বাইরে থাকা কোনো ঘটনা, যেমন:

- Natural disaster
- Courier delay
- Transportation disruption
- Government restrictions
- Technical failure
- Third-party service interruption
- Force majeure events

এর কারণে কোনো delay বা service interruption হলে NAGRAM তার জন্য দায়ী থাকবে না।

তবে applicable law অনুযায়ী customer-এর যেসব statutory rights রয়েছে, সেগুলো এই Terms of Service দ্বারা বাতিল করা হবে না।

১৯. Fraudulent or Abusive Orders

NAGRAM fraudulent, fake, abusive বা intentionally non-receivable orders-এর বিরুদ্ধে প্রয়োজনীয় ব্যবস্থা নেওয়ার অধিকার রাখে।

একই customer-এর repeated:

- Fake orders
- Unreasonable cancellations
- Parcel refusal
- Excessive returns
- False claims

ইত্যাদি পাওয়া গেলে NAGRAM ভবিষ্যতে order গ্রহণ না করার বা advance payment চাওয়ার অধিকার রাখে।

২০. Changes to These Terms

NAGRAM প্রয়োজন অনুযায়ী এই Terms of Service পরিবর্তন, update বা modify করতে পারে।

Updated version website-এ প্রকাশ করার পর revised terms কার্যকর হবে এবং Last Updated date পরিবর্তন করা হবে।

Website ব্যবহার বা order করার আগে customer-এর সর্বশেষ Terms of Service review করার পরামর্শ দেওয়া হচ্ছে।

২১. Governing Law

এই Terms of Service এবং NAGRAM-এর সাথে আপনার transaction বা website usage সম্পর্কিত বিষয়সমূহ বাংলাদেশের প্রযোজ্য আইন ও বিধি অনুযায়ী পরিচালিত হবে।

Please read these Terms of Service, Shipping Policy, and Return & Refund Policy carefully before ordering any product.

1. Website Usage Terms

This website and its content may only be used for lawful purposes.

When using the website, you agree to:

- Not place orders using the identity of another person or entity;
- Not place fraudulent or fake orders;
- Not attempt to damage the website's security or functionality;

NAGRAM reserves the right to cancel any order or take appropriate action if suspicious, fraudulent, or abusive activity is detected.

2. Product Information

- Specifications
- Size
- Color
- Materials
- Features
- Availability

is provided to give customers an understanding of the product.

However, actual product color may appear somewhat different from images due to device display, lighting, photography, or screen settings.

If any product's availability, specification, price, or other information is incorrect, NAGRAM reserves the right to correct it as necessary.

3. Product Price

Product prices displayed on the website may change.

NAGRAM may at any time:

- Change product prices;
- Change discounts or promotional offers;
- Discontinue any offer;
- Change product availability.

However, if any price-related issue arises after an order is received and confirmed, appropriate action will be taken in consultation with the customer.

4. Order Placement

Submitting an order through the website does not mean that the order is automatically final or confirmed.

After an order is submitted, NAGRAM may verify the order information as necessary.

For order confirmation, we may contact the customer via:

- Phone call
- SMS
- WhatsApp
- Or other communication methods

The order may be confirmed after necessary verification is completed.

5. Order Confirmation

NAGRAM reserves the right to accept, verify, modify, or cancel any order.

Additional verification may be required before order confirmation in the following situations:

- High-value orders
- Suspicious orders
- Multiple orders from the same customer
- Incorrect or incomplete information
- High delivery risk based on previous delivery/return history
- Product availability issues
- Pricing or website errors
- Suspicion of fraudulent activity

The order may be cancelled if customer verification cannot be completed.

6. Cash on Delivery (COD)

NAGRAM generally offers Cash on Delivery (COD) service.

For regular COD orders, the customer will pay the applicable remaining amount at the time of product delivery.

However, NAGRAM may request advance payment for certain orders.

Detailed rules for advance payment are provided in our Shipping Policy.

7. Advance Payment

In certain situations, NAGRAM may request partial advance payment before order confirmation or dispatch.

This may include:

High-Value Orders:

For relatively high-value orders, up to 10% of the total order value may be requested as advance payment.

Previous Delivery / Return History:

If the customer's previous delivery, cancellation, return, or non-receipt history indicates higher delivery risk:

- BDT 200 advance, or
- 10% of the total order value

may be requested, depending on the order circumstances.

If advance payment is taken, the remaining applicable amount will be paid at the time of delivery.

8. Order Cancellation

If cancellation is needed before order dispatch, the customer should contact NAGRAM as soon as possible.

If cancellation or parcel return is requested after order dispatch, applicable delivery and return charges may apply.

If a customer wishes to cancel an order after accepting delivery solely because they do not like the product, our Instant Return Policy and Return & Refund Policy will apply.

9. Instant Return

For COD orders, customers may inspect the product in front of the delivery agent and return it to the delivery agent if they do not like the product, where permitted by courier service rules.

In this case, the applicable delivery charge must be borne by the customer.

Instant Return will not apply after the delivery agent has left solely because the customer does not like the product.

Detailed conditions for Instant Return are provided in the Return & Refund Policy.

10. Return & Exchange

If a product is defective, damaged, wrong, significantly different from the description, or has another eligible issue, the customer may apply for Return or Exchange according to our Return & Refund Policy.

Applicable eligibility requirements must be met for Return or Exchange.

Especially for post-delivery Return/Exchange:

- Product must be unused (except for limited testing for functional defect verification);
- Original packaging must be retained;
- All applicable accessories must be included;
- NAGRAM must be notified within the specified time.

Detailed conditions for Return and Refund are provided in our Return & Refund Policy.

11. Refund / Cashback

If a Return or Refund is approved, the returned product will be inspected for product, packaging, and accessories after it reaches NAGRAM.

If the product and returned package are in proper condition according to policy, the full refund/cashback process will be initiated.

Since Refunds are only provided for NAGRAM errors or confirmed defects, no Delivery Charge, Return Delivery Charge, Packaging & Processing Fee, or other charges will be deducted from the Refund amount. The customer will receive the full Refund.

12. Delivery

NAGRAM delivers products using third-party courier and delivery services.

Current estimated delivery time:

- Within Dhaka City: 1–2 working days
- Outside Dhaka: 2–3 working days

Delivery time may vary due to public holidays, other holidays, natural disasters, bad weather, courier-related issues, or other circumstances beyond NAGRAM's control.

13. Customer Information

When placing an order, the customer must provide accurate:

- Name
- Mobile number
- Delivery address
- And other required information

NAGRAM will not be responsible for delivery failure due to incorrect or incomplete information.

Details about the use and protection of customer-provided information are provided in our Privacy Policy.

14. Promotional Offers

NAGRAM may offer promotional campaigns, discounts, bundle offers, free delivery, or other promotional offers from time to time.

Each promotional offer may have its own:

- Eligibility
- Duration
- Product selection
- Quantity limitations
- Terms and conditions

NAGRAM reserves the right to change, suspend, or discontinue any promotional offer as necessary.

15. Intellectual Property

Content on the NAGRAM website, where applicable:

- Brand name
- Logo

may be the property of NAGRAM or the relevant rights holder.

- Courier/delivery providers

The applicable terms and policies of the relevant provider may apply when using third-party services.

17. Website Availability

We strive to keep the website operational as continuously as possible. However, the website may be temporarily unavailable due to maintenance, technical issues, server problems, security incidents, or other reasons.

NAGRAM does not guarantee uninterrupted or error-free operation of the website.

18. Limitation of Liability

NAGRAM strives to supply products and services with reasonable care.

However, NAGRAM will not be liable for any delay or service interruption caused by circumstances beyond NAGRAM's reasonable control, such as:

- Natural disaster
- Courier delay
- Transportation disruption
- Government restrictions
- Technical failure
- Third-party service interruption
- Force majeure events

However, any statutory rights of the customer under applicable law are not waived by these Terms of Service.

19. Fraudulent or Abusive Orders

NAGRAM reserves the right to take necessary action against fraudulent, fake, abusive, or intentionally non-receivable orders.

If the same customer repeatedly engages in:

- Fake orders
- Unreasonable cancellations
- Parcel refusal
- Excessive returns
- False claims

NAGRAM reserves the right to refuse future orders or request advance payment.

20. Changes to These Terms

NAGRAM may change, update, or modify these Terms of Service as necessary.

The revised terms will become effective upon publication of the updated version on the website, and the Last Updated date will be changed.

Customers are advised to review the latest Terms of Service before using the website or placing orders.

21. Governing Law

These Terms of Service and matters relating to your transaction with NAGRAM or website usage shall be governed by the applicable laws and regulations of Bangladesh.
